Some Important Legal Maxims




The following Maxims may be made by heart. 

But remember that most of the teachers do not teach them 
with proper Latin pronunciation.

L. Caveat emptore = Let the buyer beware

L. Caveat venditor = let the seller beware

L. Caveat lector = let the reader beware

L. Actus non facit reum nisi mens rea  = Act does not make a person guilty, but for the mind is guilty.

L. Nemodat quod non habet  = no one gives what he doesn't have

F. Autrefois acquit = previously acquitted

F. Autrefois convict = previously convicted

L. Causa Proxime, non remota spectatur = The proximate and not the remote cause must be looked into

L. Damnum sine injuria = Damage without injury (of legal right)

L. Falsus in uno falsus in omnibus = False in one thing, false in all

L. Generalia specialibus non derogant = General does not derogate Special (Law)

L. Ignorantia juris non excusat = Ignorance of the law is no excuse

L.Necessitas non habet legem = Necessity has no law

L. Novus actus interveniens = The new intervening act

L. Qui facit per alium facit per se = He who acts through another does the act himself

L. Quid pro quo = something for something

L. Ubi jus ibi remedium = Where there is a right there is a remedy

L. Audi alterum partem = Listen to the other part

L. Nemo judex in causa sua = Nobody should be judge in his own cause

L. Rebus stic stantibus = Matters standing so = changed circumstances

L. Res ipsa loquitur = the thing speaks for itself

L. Spes successionis = hope of succession

L. Ut res magis valeat quam pereat = That the thing may rather have effect than be destroyed

L. Expressio unius est exclusio alterius = Expression of one is the exclusion of another

L. Obiter dicta = incidentally said

L. Salus populi est suprema lex = The safety of people is the supreme law

L. Volenti non fit injuria = to a willing person, injury is not done

L. Ultra vires = beyond the powers

L. Ratio decidendi = The reason for the decision

L. Lis pendens = a suit pending

L. Injuria Sine Damnum = Injury without damage
